Meta Delays Commercial Terms Update as Publishers Demand Withdrawal – Unite.AI
ShareShareShareShareShare

Meta has moved the effective date of its updated Commercial Terms and Self-Serve Ad Terms to November 20, 2026, after the News/Media Alliance, a nonprofit trade group representing more than 2,000 U.S. publishers, demanded the company withdraw the terms over language authorizing Meta to crawl websites associated with business accounts.

Meta Pushes Terms Update to November 20

As of October 23, 2026, a notice atop Meta’s Commercial Terms page tells businesses that Meta is updating the terms and that the updates will go into effect on November 20, 2026, linking to the updated text. The currently governing version of the Commercial Terms is dated March 6, 2024.

Meta’s Business Help Center states that from November 20, 2026, updated versions of the Meta Commercial Terms and the Self-Serve Ad Terms will take effect. Under the update, the Product Catalog Terms are incorporated into the Commercial Terms and the Ad Creative Generative AI Terms are incorporated into the Self-Serve Ad Terms. Meta says the changes reduce overlap between its agreements and improve the clarity of the terms that apply to businesses’ use of its products.

The updated Commercial Terms print an effective date of November 20, 2026. The terms had carried a claimed effective date of October 30, 2026, the date the News/Media Alliance cited in demanding their withdrawal.

The Commercial Terms apply to access or use of Meta’s products for a business or commercial purpose. The updated text defines such purposes to include using ads or marketing messages, selling or listing products, developing apps, creating or using a product catalog, managing a Page or a Group for business purposes, using business products such as Ads Manager or Meta Business Suite, and using Meta’s measurement services.

What the Updated Terms Authorize

Under the updated terms, a business authorizes Meta to use automated software, including web scrapers, bots, robots, spiders, crawlers, and user agents, and to create test credentials, to access, index, cache, analyze, collect, retrieve, or crawl the domains, web pages, and URLs, and any content available through them, that are associated with the business’s products or services or made available through its or its users’ use of Meta Company Products, and to periodically pull updates. The stated purpose is to provide, develop, improve, research, and maintain advertising and business products, including products that help businesses create and deliver ads and other commercial content, and to maintain the integrity and security of Meta Company Products.

Separately, the terms state that users grant Meta a license to content covered by intellectual property rights that they share, post, or upload on or in connection with Meta Company Products, and that Meta may use that content as described in its Terms of Service, including to provide, develop, improve, research, and maintain Meta Company Products.

Continued access or use of Meta’s products for business purposes after notice of an update counts as acceptance of the updated terms, and a business that does not agree may stop all access or use of the products for business or commercial purposes.

The update adds an AI Features section stating that Meta may offer products and features powered by artificial intelligence, machine learning, or generative AI, that such features may make mistakes and may not always produce accurate, complete, or suitable results, and that users may not alter or remove any watermark or content-authenticating metadata generated by AI in connection with their content.

The updated terms incorporate by reference the Self-Serve Ad Terms, the Business Tools Terms, the Seller Agreement, the Meta Business Agents and Platform Terms of Service, and the Meta AI Business Assistant Supplemental Terms.

News/Media Alliance Pushes Back

The crawling language had already been revised once. According to the alliance’s letter, Meta deleted the word “train” from the initially released version after publishers objected, and the terms now say the content will be used to develop, improve, research, and maintain advertising and business products. The letter argues the revision changes little because that phrase is left undefined, and says one law professor described the revised language as still extremely broad.

In an October 16, 2026 statement, News/Media Alliance President and CEO Danielle Coffey called the terms “outrageous and probably illegal,” describing the policy as an abuse of Meta’s market power that could not be allowed to take effect on October 30.

The alliance announced on October 22, 2026 that it had delivered an open letter to Meta CEO Mark Zuckerberg demanding the company withdraw the revised terms before they took effect. The alliance describes itself as representing more than 2,000 newspaper, magazine, and digital media publishers in the United States, with membership accounting for nearly 90 percent of daily newspaper circulation and more than 500 magazine and digital-only brands.

The letter argues the terms appear to require every business using Facebook, Instagram, WhatsApp, or Messenger through a business account to grant Meta what it calls extraordinary and disproportionate privileges to exploit website content for free, with no way to decline short of abandoning Meta’s business products and access to its audience. “News publishers will be forced into providing their valuable journalism to support the development of products that may be used to compete with them for readers and advertisers, under duress and without compensation,” the letter states.

The letter characterizes Meta’s conduct as an anticompetitive exercise of market power that risks undermining the licensing market for publisher content, and cites an estimate that Meta already owes U.S. publishers nearly $2 billion a year. It also argues that blocking Meta’s crawlers through robots.txt files is impractical because publishers generally must allow Meta’s ads crawler for their advertising to function, and that the terms do not confirm Meta will abide by robots.txt restrictions.

The letter notes that Meta has publicly described the crawling provisions as applying only to its ads and business products and not as an effort to scrape news sites, and argues that if that is the case, Meta should have no objection to putting such commitments into the terms themselves.

The alliance asked Meta to respond publicly by October 26, 2026, and requested discussions on four points: the specific Meta products and uses for which scraped content would be used; how publishers could opt in to scraping separately from access to Meta’s business products; the specific crawlers, fetchers, or other bots that would be used; and how Meta would ensure that robots.txt files, registration walls, and paywalls are respected. The letter states that the alliance’s members do not consent to the terms, reserve all legal rights, and regard any use of their content for AI purposes without express written permission as contrary to applicable law. Meta’s updated Commercial Terms and Self-Serve Ad Terms carry an effective date of November 20, 2026.
